Welcome to Mannasukh (“Mannasukh,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the Mannasukh website, mobile application, and related services (collectively, the “Platform”). By accessing or using the Platform, you acknowledge that you have read, understood, and agreed to be legally bound by these Terms, our Privacy Policy, Disclaimer, Refund & Cancellation Policy, and any other policies published on the Platform. If you do not agree with these Terms, you must immediately discontinue use of the Platform.

1. Definitions

Unless the context otherwise requires:

• Platform means the Mannasukh website, mobile applications, software, and related services.
• User , Client , or Patient means any individual using the Platform.
• Therapist means an independent mental health professional registered on the Platform.
• Session means any consultation, counselling, therapy, assessment, or related service booked through the Platform.
• Content includes text, graphics, logos, videos, images, documents, reviews, and other materials available on the Platform.

2. Nature of the Platform

Mannasukh is solely a technology-enabled marketplace that facilitates introductions and appointment scheduling between Users and independent mental health professionals. Mannasukh is not a hospital, clinic, healthcare establishment, medical practice, psychology practice, counselling centre, or healthcare provider. Mannasukh does not provide medical advice, diagnosis, counselling, psychotherapy, psychiatric treatment, prescriptions, or healthcare services. The Platform only enables Users to connect with independent professionals.

3. Independent Therapist Relationship

Every therapist available on Mannasukh operates independently. Therapists are not employees, partners, agents, representatives, contractors, or affiliates of Mannasukh. Each therapist independently determines:

• Professional services
• Clinical decisions
• Diagnosis
• Treatment plans
• Counselling methods
• Fees (where applicable)
• Session duration
• Availability
• Professional opinions The therapist bears sole responsibility for their professional conduct and services.

4. No Professional Relationship with Mannasukh

Use of the Platform does not establish:

• Doctor–Patient Relationship
• Therapist–Client Relationship
• Psychologist–Patient Relationship
• Fiduciary Relationship
• Medical Care Relationship Any professional relationship exists solely between the User and the selected Therapist.

5. Eligibility

To use the Platform, you represent and warrant that:

• You are at least 18 years of age or have valid consent from a parent or legal guardian.
• You have the legal capacity to enter into binding agreements.
• The information you provide is true, accurate, and complete.
• You will comply with all applicable laws. Mannasukh reserves the right to refuse or terminate access where eligibility requirements are not satisfied.

6. User Accounts

Users may be required to create an account to access certain features. You agree to:

• Maintain accurate information.
• Keep your login credentials confidential.
• Be responsible for all activities conducted through your account.
• Notify Mannasukh immediately of any unauthorized access. Mannasukh shall not be liable for losses arising from unauthorized use of your account.

7. Booking Appointments

Appointments are subject to therapist availability. Submission of a booking request does not guarantee confirmation. Therapists may accept, decline, reschedule, or cancel appointments based on their professional judgment or availability. Mannasukh only facilitates appointment scheduling and does not guarantee therapist availability.

8. Payments

Payments made through the Platform are processed using authorized third-party payment service providers. Mannasukh does not store complete payment card information. Applicable platform fees, taxes, convenience charges, or payment gateway charges may apply. All payments are subject to successful processing by the payment provider.

9. Cancellation & Refunds

Cancellation, refund, and rescheduling requests shall be governed by the Refund & Cancellation Policy published on the Platform. Refund eligibility shall depend upon the applicable policy and the circumstances of each booking. Platform charges, payment gateway charges, taxes, and other applicable fees may be non-refundable unless required by applicable law.

10. Therapist Responsibility

Every therapist represents and warrants that they:

• Possess all required qualifications, registrations, certifications, and licences.
• Are legally authorized to practice.
• Maintain professional standards.
• Comply with applicable laws and ethical guidelines.
• Are solely responsible for their professional advice, diagnosis, counselling, treatment, and interactions with Users. Mannasukh does not supervise, control, or direct the clinical practice of therapists.

11. User Responsibility

Users agree to:

• Provide accurate information.
• Attend scheduled appointments.
• Follow therapist instructions at their own discretion.
• Respect therapists and Platform staff.
• Refrain from abusive, illegal, fraudulent, or harmful conduct. Users are solely responsible for decisions made based on advice received from therapists.

12. Emergency Services

The Platform is not intended for medical emergencies or crisis intervention. If you are experiencing:

• Suicidal thoughts
• Self-harm risk
• Psychiatric emergency
• Medical emergency
• Threat to life or safety Immediately contact local emergency services or visit the nearest hospital. Mannasukh does not monitor emergency situations and cannot provide emergency assistance.

13. Confidentiality

Therapists are independently responsible for maintaining confidentiality obligations applicable to their professional practice. Mannasukh does not guarantee absolute confidentiality of communications transmitted over the internet and cannot ensure that electronic communications will always be secure or free from unauthorized access. Users acknowledge the inherent risks associated with online communications and teletherapy sessions.

14. Teletherapy and Online Sessions

Users acknowledge that online therapy sessions may involve:

• Internet connectivity issues
• Audio or video interruptions
• Technical failures
• Device compatibility limitations
• Reduced ability to respond to emergencies Mannasukh shall not be liable for losses, delays, interruptions, or dissatisfaction arising from technical issues beyond its reasonable control.

15. Intellectual Property

All Content available on the Platform, including but not limited to logos, trademarks, text, graphics, software, designs, and website layout, is owned by or licensed to Mannasukh and is protected under applicable intellectual property laws. Users shall not:

• Copy, reproduce, or distribute Content without permission.
• Modify or create derivative works.
• Use Mannasukh trademarks without authorization.
• Reverse engineer any part of the Platform.

16. User-Generated Content

If Users submit reviews, feedback, testimonials, comments, or other content, they grant Mannasukh a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and publish such content for Platform operations and promotional purposes. Users represent that their content does not violate any third-party rights or applicable laws.

17. Prohibited Activities

Users shall not:

• Provide false information.
• Impersonate another person.
• Harass or threaten therapists or other users.
• Upload unlawful, abusive, defamatory, obscene, or harmful content.
• Attempt unauthorized access to the Platform.
• Use automated tools, bots, or scraping software.
• Interfere with Platform security or functionality.
• Use the Platform for fraudulent or illegal purposes.

18. Privacy and Data Protection

Collection, use, storage, processing, and disclosure of personal information shall be governed by the Mannasukh Privacy Policy. By using the Platform, Users consent to such processing in accordance with applicable Indian laws and the Privacy Policy.

19. Third-Party Services

The Platform may integrate with third-party services, including payment gateways, communication tools, analytics providers, and cloud service providers. Mannasukh is not responsible for the acts, omissions, availability, security, or policies of third-party service providers.

20. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis . To the fullest extent permitted by law, Mannasukh disclaims all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Accuracy
• Reliability
• Availability
• Non-infringement
• Uninterrupted access Mannasukh does not guarantee that the Platform will always be error-free or continuously available.

21. Limitation of Liability

To the maximum extent permitted under applicable law, Mannasukh, its founders, directors, officers, employees, affiliates, and representatives shall not be liable for any:

• Direct damages
• Indirect damages
• Incidental damages
• Consequential damages
• Special damages
• Exemplary damages
• Punitive damages
• Loss of profits
• Loss of data
• Emotional distress
• Personal injury claims
• Dissatisfaction with therapy outcomes This limitation applies to claims arising from:
• Use of the Platform
• Professional services provided by therapists
• Appointment scheduling
• Cancellations or rescheduling
• Technical interruptions
• Reliance on information available on the Platform In no event shall Mannasukh’s aggregate liability exceed the amount actually paid by the User to Mannasukh for the specific transaction giving rise to the claim.

22. Indemnification

Users agree to defend, indemnify, and hold harmless Mannasukh, its founders, directors, employees, affiliates, and representatives from and against any claims, liabilities, losses, damages, costs, and expenses arising from:

• Violation of these Terms
• Misuse of the Platform
• User-provided content
• Violation of applicable laws
• Infringement of third-party rights
• Disputes between Users and Therapists

23. Suspension and Termination

Mannasukh may suspend, restrict, or terminate access to the Platform at its sole discretion, with or without notice, if:

• These Terms are violated.
• Fraudulent activity is suspected.
• Illegal conduct is detected.
• Platform security is threatened.
• Required by law or regulatory authorities. Termination does not affect accrued rights, obligations, or liabilities existing prior to termination.

24. Force Majeure

Mannasukh shall not be liable for any failure or delay resulting from events beyond its reasonable control, including natural disasters, pandemics, government actions, internet outages, cyberattacks, power failures, labour disputes, or other force majeure events.

25. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Delhi, New Delhi .

26. Dispute Resolution and Arbitration

Before initiating court proceedings, the parties shall attempt to resolve disputes amicably. If a dispute remains unresolved, it may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Delhi , and proceedings shall be conducted in English.

27. Changes to Terms

Mannasukh reserves the right to modify these Terms at any time. Updated Terms will be posted on the Platform with a revised effective date. Continued use of the Platform after such changes constitutes acceptance of the updated Terms.

28. Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

29. Entire Agreement

These Terms, together with the Privacy Policy, Disclaimer, Refund & Cancellation Policy, and other applicable policies, constitute the entire agreement between the User and Mannasukh regarding use of the Platform.
